StudentEB5 today published a comprehensive strategy guide examining how international students on F-1 visas can use the EB-5 Immigrant Investor Program as a self-sponsored alternative to the increasingly unpredictable F-1 to H-1B to green card pathway.
The guide, titled EB-5 Immigrant Investor Program: Strategies and Project Evaluation for International Students, outlines how the EB-5 Reform and Integrity Act of 2022 enables students to invest a minimum of $800,000 in a qualifying Targeted Employment Area project to secure U.S. permanent residency without relying on employer sponsorship or winning the H-1B lottery.
The problem: an unreliable path from campus to green card
The traditional F-1 to OPT to H-1B route has grown increasingly fragile. The H-1B program’s annual cap of 85,000 visas attracted over 470,000 registrations in 2025, leaving the majority of qualified graduates without sponsorship. For Indian and Chinese nationals who do secure an H-1B, employment-based green card backlogs in the EB-2 and EB-3 categories can stretch decades or longer under current per-country limits.
Concurrent filing delivers near-term work and travel authorization
Under the RIA’s concurrent filing provisions, F-1 students lawfully residing in the United States can file Form I-526E and Form I-485 simultaneously, and also apply for an Employment Authorization Document and Advance Parole travel document at the same time. These interim benefits are typically approved within four to eight months, granting unrestricted work authorization and international travel privileges while the underlying EB-5 petition is adjudicated. This removes dependence on OPT time limits, STEM OPT extensions, and employer H-1B sponsorship.
Benefits of acting early
The guide highlights significant advantages for students who initiate the EB-5 process before or during university enrollment. Permanent residents are evaluated under the domestic applicant pool for university admissions, which carries higher acceptance rates than international student quotas. Green card holders qualify for in-state tuition rates at public universities, reducing educational costs by up to two-thirds. Students can also accept internships and post-graduation employment without the administrative constraints of OPT or STEM OPT.
How students can fund an EB-5 investment
The report covers four common funding approaches: Home Equity Lines of Credit, Self-Directed IRAs using rolled-over retirement funds, Securities-Based Lines of Credit borrowed against investment portfolios, and documented gifts from parents or relatives. Each method requires at least seven years of financial documentation to satisfy USCIS source-of-funds requirements.
Time-sensitive deadlines
The report urges students to act before September 30, 2026, when a grandfathering provision under the RIA protects petitioners from potential non-reauthorization of the Regional Center Program. Students who file before this date also avoid a projected increase in the minimum investment amount from $800,000 to approximately $920,000 for TEA projects, expected in 2027.
